Mr L Andrucevic v Kitchen & Duct Cleaning Limited — 2020

The claimant, Mr L Andrucevic, said he worked as a cleaner for Kitchen & Duct Cleaning Limited and that his last day worked was 20 March 2020. He said Mr Godfrey told him it was the last week of work, that the respondent would apply for the Government scheme, and that he should stay at home. The tribunal had no witness statements or bundle and relied on the claimant's evidence and the respondent's response, as the respondent did not attend the CVP hearing.

The tribunal accepted that on 15 April 2020 the respondent's secretary emailed the claimant saying pay was being put through on Sunday together with paperwork, but when wages were due on 25 April 2020 no money had been paid. The claimant then spoke to Mr Godfrey, who said he had been told the claimant had found work elsewhere; the claimant denied this. Mr Godfrey later told him there was no job and that his P45 and holiday pay would be sent. The claimant accepted he later received his P45 and holiday pay, and the tribunal accepted that he did not find another job until the end of May.

On the claimant's evidence that he normally took home around £400 per week and had been available for work for five weeks, the tribunal was satisfied that he had suffered an unlawful deduction of wages. It declared that the respondent was to pay £2,000 less any Income Tax and National Insurance for the period from 20 March 2020 to 25 April 2020.
