Miss J Russell v NHS Professionals Limited — 2025

Miss J Russell presented her claim on 5 June 2024. The hearing on 17 June 2025 at Watford was the first hearing in the case. The claimant did not attend and was not represented. The tribunal recorded that the CVP link had been sent to the email address on the claim form the previous afternoon, that a further email from the clerk at 10:10 a.m. went unanswered, and that a telephone call reached an automated message with no facility to leave a message.

Employment Judge Dick also noted that the Tribunal had had no email contact from the claimant during 2025, and that an order dated 19 March 2025 requiring further information, including information about the disability relied on, had not been complied with. The respondent said it had not had correspondence from the claimant since receipt of the claim form and had sent chaser emails on 15 April and 4 June 2025.

Applying rule 47, the judge decided to dismiss the claim. The reasons given were that the absence did not appear to be unexpected, the available information pointed to the conclusion that the claim was no longer being actively pursued, and postponement or adjournment would serve no useful purpose. The judgment states that the claimant may apply for reconsideration under rules 68 to 70 within 14 days if she has a good reason for her absence.
