Tribunal's reasoningThe claimant was employed at the Lutton Farm establishment and was dismissed by reason of redundancy on 3 May 2024. Twenty or more employees at the establishment were placed at risk of redundancy on or within 90 days of 11 April 2024, and there was no recognised trade union or elected employee representatives. The tribunal found that the respondents had failed to comply with the collective consultation requirements of section 188 TULRCA 1992, and the claim for a protective award under section 189 succeeded against the First to Fifth respondents.
