The tribunal considered at a preliminary hearing whether the claimant was a disabled person within section 6 of the Equality Act 2010 at the times relevant to his disability discrimination claims, namely 12 to 16 February 2024. The claimant relied on migraines and accepted that if he could not show disability, his claims could not continue.

The tribunal accepted that the claimant had a physical impairment and that the symptoms described in his impact statements were adverse and substantial. However, it found that the evidence did not show a substantial adverse effect on normal day-to-day activities as at February 2024, taking into account that the claimant was controlling the condition with cannabis and that the tribunal was not able to disregard that control as treatment or correction on the evidence before it.

The tribunal found that the claimant had not shown, to the required standard of proof, that he was a disabled person as at February 2024. The disability discrimination claims were therefore dismissed, and the respondent's strike out and deposit order applications did not need to be considered.
