In person For the v Navitas Life Sciences GmbH — 2021

The case was heard on 26 October 2021 at Watford by CVP before Employment Judge Alliott sitting alone. The respondent did not attend. The tribunal noted emails indicating that Navitas Life Sciences GmbH was in German insolvency proceedings and that the claimant had been told by insolvency administrators on 25 October 2021 that he would have no advantages if he proceeded, but the judge was satisfied the respondent had notice and decided not to participate. The tribunal proceeded in the respondent's absence.

The claimant said he worked in April, May and June 2020 and had not been paid. He also said his notice period was one month and that his employment ended on 30 June 2020. The tribunal accepted that evidence and found that the claimant had not been paid for three months' employment and had also not been paid his notice period.

The claimant stated that his gross pay was £3,006 per month. The tribunal calculated the unpaid sum as four months at £3,006, making £12,024, and entered judgment for that gross amount subject to tax, national insurance and other lawful deductions. The judgment does not split the figure between unpaid wages and notice pay, and it records the award as arising from unauthorised deductions of wages and/or breach of contract.
