The tribunal determined whether the claimant had a disability under the Equality Act 2010 between 20 December 2021 and 7 February 2022. The condition relied on was mixed anxiety and depression, which the respondent accepted she had, while disputing whether it was long term or had a substantial adverse effect on normal day-to-day activities.

The tribunal found that the claimant's condition was long term and that, but for medication, it would have been likely to have a substantial adverse effect. It also found that even while taking medication the condition had a substantial adverse effect, including on full-time working, staying awake during normal waking hours, and variable ability to cook for herself.

The tribunal did not find that the claimant had proved a long-term substantial adverse effect in relation to the cognitive and workplace issues she identified, including processing verbal information, confusion when things were not explained carefully, dealing with unusual stresses, and needing time off work. No remedy was considered in this judgment.
