Tribunal's reasoningThe claimant, Miss Kym Siggers, worked for the respondent sole trader from 1 January 2005 until 6 April 2020. Her weekly gross pay was £490.00 and her net weekly pay was £436.11. The respondent closed his business, P and F Services, on 6 April 2020 without paying notice pay or a redundancy payment.
The tribunal held that the claimant was entitled to 12 weeks' notice. It therefore awarded damages in lieu of notice pay for breach of contract at 12 x £436.11, totalling £5,233.32.
The tribunal also found that the claimant was redundant. On the basis that she had 15 years' service and had worked three full years when she was over 41, it calculated the statutory redundancy payment as 16.5 x £490, producing an award of £8,085.00.
The holiday pay complaint was dismissed. The tribunal said there was no evidence before it about the claimant's holiday entitlement or holidays taken, and noted that neither side had produced relevant paperwork or given relevant evidence on that issue. The total monetary award recorded by the judgment was £13,318.32.
