Her letter of engagement required two weeks’ notice to terminate the contract. She worked 6.75 hours on 3 April 2023, resigned on 4 April 2023 giving two weeks’ notice, and the respondent replied that it could work out her notice and deal with handover on Thursday. The claimant was then instructed not to attend the office.
The claimant submitted an invoice on 18 April 2023 for her 3 April 2023 pay and notice-period pay, but the respondent did not pay it. Although the ET3 stated that the claimant had been paid for the period covered by the claim, the respondent provided no written evidence or documentation to support that assertion, and no witness evidence was filed. The tribunal also noted that the respondent was absent from the hearing and proceeded in its absence.
On that basis, the tribunal found that the respondent had made unauthorised deductions from the claimant’s wages and ordered payment of the gross sum of £525.25. The judgment does not apportion the award between the 3 April work and the notice-period element, and it records no separate interest or additional remedy.
