Tribunal's reasoningThe Tribunal found that the respondent proposed redundancies affecting more than 20 employees at one establishment. Employees were first told about the proposed redundancies on 15 November 2018 and were dismissed on 4 December 2018, after one consultation meeting and before the minimum 30-day consultation period had been completed.
The Tribunal found that there was no election or ballot for employee representatives, the respondent did not provide all relevant written information, and the employee representatives did not have sufficient information or adequate time to respond. Although employees made proposals to avoid redundancies at the first meeting, the planned further discussion did not take place, and there was no proper consultation about alternatives to redundancy or attempt to reach agreement.
The Tribunal declared that the respondent failed to comply with sections 188 and 188A TULR(C)A 1992 and made a 30-day protective award for each claimant. It also upheld Mr Chan's claims for notice pay and holiday pay, and Mr Van Tonder's claim for notice pay, because those sums had not been paid.
