Tribunal's reasoningThe claimant had been employed by the respondent since February 2016 in a number of roles, including a fitness instructor role and a Central Work Bank zero-hours role. In April 2020 the respondent wrote to Central Work Bank workers saying they would be furloughed on 80% of average monthly earnings, and the claimant agreed to the variation. The tribunal found that the agreement was to pay 80% of average monthly earnings, but that the term was not sufficiently precise on its own and had to be read with an implied term as to how those earnings were to be calculated.
