Key findings
Tribunal's reasoningThe tribunal first extended time for presentation of the claim form, finding that it was not reasonably practicable for the claimant to present it in time and extending time to 17 January 2024. The judgment then dealt with claims for unauthorised deductions from wages, holiday pay, and a request for a breakdown of commission payments.
The claim under Part II Employment Rights Act 1996 succeeded in two parts. The tribunal found that from 27 June 2022 to 16 June 2023 the hourly rate paid did not equate to the contractual salary of £23,000, and that the claimant was also not paid for the period 23.11.22 to 2.12.22. It ordered the respondent to pay £887.52 gross. The tribunal also found a further unauthorised deduction in relation to June 2023 commission: the commission should have been £599.00 under the amended payslip, but the claimant was paid £525.60, so a further £73.40 gross was awarded.
The holiday pay claim, said to date back to 2022, was dismissed because carrying over annual leave was expressly prohibited by the contract of employment and the claim was brought out of time. The request for a clear and comprehensive breakdown of commission payments was also dismissed because it was not within the tribunal's jurisdiction. No separate interest or other remedy was recorded, and the total gross award appears to be £960.92.
