Tribunal's reasoningEmployment Judge S Moore, sitting alone at Watford (CVP) on 24 September 2024, heard the claim of Mr R Bacon against Bash HR and Admin Services Ltd (t/a The Orwell Hotel). The Respondent did not present a response and did not appear or have representation at the hearing, which was listed to determine liability and remedy. The judge made an order changing the name of the Respondent to Bash HR and Admin Services Ltd after the Claimant produced a payslip identifying his employer.
On the evidence of the Claimant and the documents to which he was referred, the tribunal found that the Claimant was employed as a painter and decorator between 12 June 2023 and 14 August 2023. He was initially informed on 2 August 2023 that his contract was being terminated with one week's notice, but on 3 August 2023 the General Manager Mr Pasinski indicated he would instead be required to work his notice from 7 August 2023, which he did. The Claimant was not paid for the last three weeks of his employment, and his attempts to obtain payment were unsuccessful.
On the basis of a 40-hour week at £12 per hour, the tribunal found the Claimant entitled to £1,440 gross. The claim of breach of contract and/or unlawful deduction of wages therefore succeeded in the sum of £1,440 (gross), with the Claimant responsible for any tax due on that sum.
