The tribunal found that the respondent had failed to pay him in accordance with regulation 14(2) of the Working Time Regulations 1998.
The claim was presented on 5 November 2024, following early conciliation between 12 September and 3 October 2024, and was two days out of time. The tribunal accepted the claimant’s written evidence that, until shortly before 3 November 2024, he had been assured and believed that the respondent would pay what was owed. He realised shortly before presenting his claim that payment would not be made. The tribunal found that timely presentation had not been reasonably practicable and that the claim was brought within a further reasonable period. It would have reached the same conclusion had payment been due on 20 June 2024.
The determination was made under rule 22 following a case management hearing on 20 April 2026 and further information supplied by the claimant. The respondent was ordered to pay £2,660, with the claimant responsible for any tax or National Insurance.
