The claimant, employed since 30 January 1995, was dismissed by reason of redundancy on 30 April 2022. The respondent, in administration, did not attend and the administrators indicated they did not intend to defend the claims, so the hearing proceeded in their absence. The claim for a redundancy payment was brought within the six-month limit; the notice pay and holiday pay claims were 18 days late, but the tribunal accepted it had not been reasonably practicable for the claimant to present them in time and that they were presented within a reasonable period thereafter.

The tribunal found that the claimant was entitled to a statutory redundancy payment of £16,844.50 based on 27 years' continuous service, age 60, and a salary of £65,000. The breach of contract claim for notice pay succeeded in the sum of £15,000, with credit to be given for £5,000 already paid, and the respondent was ordered to pay outstanding holiday pay of £1,582.50 as calculated in a document produced by the respondent itself.

The claimant's additional claim for a long service payment was dismissed because the tribunal had no power to make such a payment.
