Mr A Thornhill v Ahearne Personnel Ltd — 2021

This was a Rule 21 judgment. The tribunal found that Ahearne Personnel Ltd had made an unauthorised deduction from Mr A Thornhill's wages and therefore upheld the unlawful deduction from wages claim. The judgment ordered the respondent to pay £1,326.90 gross, with the claimant responsible for tax and national insurance.

In the reasons, Employment Judge Quill recorded that no response had been received by 1 December 2020. The claimant quantified the claim by email on 31 January 2021. The respondent later purported to submit a response on 4 March 2021, but the tribunal noted that it was not on the required form and that the application for an extension of time would not be considered until a valid form was submitted. Although the respondent said it would post the form on 26 March 2021, no valid form or additional reasons for an extension were received, and the tribunal concluded it was appropriate to issue judgment.
