Tribunal's reasoningOn 18 March 2022, Employment Judge Tynan sitting alone heard the claims of Mrs J Cammish, Miss S Langhorn, Miss C Poole, Ms N Webb and Miss H Maughan against Catherine Limited and The Retreats (Cambridge) Limited. The tribunal held that there was no 'relevant transfer' within Regulation 3(1) of the TUPE Regulations 2006 of the first respondent's business, or any part of it, to the second respondent.
Because there was no relevant transfer, the first respondent was solely liable for the redundancy payments. The tribunal found that the claimants were dismissed by the first respondent by reason of redundancy and held that it was just and equitable that they should receive redundancy payments of £498.75 to Mrs J Cammish, £459.00 to Miss Langhorn, £310.00 to Miss C Poole, £1,823.08 to Ms N Webb and £1,135.78 to Miss H Maughan, a total of £4,226.61.
