The tribunal found his employment ended by reason of redundancy arising from a financial downturn in the respondent's business following the 2020 lockdown and Coronavirus pandemic. Notice of termination was given on 21 May 2020, and he was entitled to one week's notice or one week's pay in lieu.
The tribunal accepted the respondent's explanation of the sums paid at termination. It found that the claimant was on furlough pay throughout 21 May to 31 July 2020 at 80% of his gross basic pay, with an additional 20% paid for one week to cover the notice entitlement. It also found that he was paid full pay for any accrued outstanding holiday during that period.
On that basis, the tribunal was satisfied that the claimant had been paid the correct sums due to him. His claim for unlawful deduction of wages therefore failed and was dismissed.
