Prior to the hearing, the respondent conceded the majority of the claimant’s claims and adduced no evidence. The claimant gave evidence on the matters that remained disputed and the respondent made submissions. The tribunal therefore determined only the live issues before it on the written and oral material available at the hearing on 13 April 2023 before Employment Judge Hanning.

The claimant’s claim for unlawful deduction from wages succeeded. The tribunal held that the respondent was required to pay £11,156.01 being net salary due for July and September 2022, together with £4,210.00 subject to deductions for tax and national insurance. The judgment does not separate any additional remedy components beyond those sums.

A document submitted on 16 March 2023 referred to ‘automatically unfair redundancy’ and appeared to amount to an unparticularised victimisation claim. The tribunal recorded that no permission had been given to amend the claim in that way, so it was not a live claim and did not fall to be determined. The tribunal added that if the claimant wished to pursue victimisation, he would need to make a formal application to add that claim, with proper details of the protected act relied on, by 27 April 2023.
