Tribunal's reasoningAt the hearing on 19 June 2023 before Employment Judge George, the respondent did not attend although it had been given notice of the hearing. The tribunal amended the respondent identity to Bacerius Investments Ltd and Delesius Investments Ltd together as Trustees of Sutton Place Property Unit Trust. It held that it had jurisdiction to consider the claimant's claims for redundancy payment, unauthorised deduction from wages, unpaid holiday pay on termination of employment, and breach of contract for notice pay because it was not reasonably practicable for him to present the claims within three months of the relevant date and he presented them within a reasonable further period.
The claimant succeeded on all of the substantive monetary claims. The tribunal awarded a redundancy payment of £7,708.50, holiday pay accrued and not taken on termination of £1,839.20 gross, and notice pay of £1,929.56 gross. The unauthorised deduction from wages claim succeeded in the sum of £14,016.20 gross, made up of unpaid wages for March, April, May and June 2022, canine allowance payments of £1,250, employer pension contributions of £655.92, and overtime payments of £921.60. The total award was £25,493.46, some of which was subject to tax and national insurance as appropriate.
