Mr D Ainsworth v Oxis Energy Limited (in administration) — 2022

This was a judgment by consent. The tribunal recorded that permission was granted for the claimant's claims to proceed against the respondent, and that the moratorium in relation to those claims was lifted, subject to the conditions agreed by the claimant on 16 May 2022. It also recorded that the claimant had been employed by the respondent and was dismissed on 4 May 2021 by reason of redundancy.

The protective award claim under section 189 of the Trade Union and Labour Relations (Consolidation) Act 1992 succeeded. The tribunal ordered payment for a protected period of 60 days beginning on 4 May 2021, in the sum of £13,026.60.

The judgment also recorded success for arrears of wages, unpaid expenses and unpaid holiday pay. It ordered £4,361.96 as arrears of wages and £178.89 as holiday pay. The judgment stated that payments would be subject to deductions of tax and National Insurance as required by law, that the sums did not include amounts already paid before the date of judgment, that the Employment Protection (Recoupment of Benefits) Regulations 1996 applied, and that there would be no order as to costs or interest, with each party bearing its own costs. It further recorded that all further proceedings were withdrawn.
