The tribunal found that the claimant had worked for the respondent since 23 October 2016. It accepted that she had not been given a written contract or section 1 statement, that her net pay was £1,881 per month, and that she was also entitled to commission. It also accepted that a proposed settlement agreement in January 2019 was never concluded. The claimant had not been dismissed verbally or in writing, and the tribunal found that her employment continued.
On remedy, the tribunal held that the claimant was entitled to her basic rate of pay, but not to commission or unpaid holiday because those matters had not been pleaded, and not to notice pay because the contract continued. It found that she was owed wages for the balance of 2019, from mid-January to the hearing date, together with half a month's pay for December 2018. The sum awarded was £23,512.50 net, with the respondent required to account for any Income Tax and National Insurance due.
