Mr Sofiane Amirouchen v Mr M Varda and 2 others — 2020

The claimant, Mr Sofiane Amirouchen, appeared in person with an interpreter. None of the three respondents attended the hearing, despite notice being sent by email on 31 July 2020. The tribunal adjourned briefly to see whether the respondents could be contacted, but proceeded in their absence when no contact was made and the only telephone number on file was temporarily unavailable.

On the wages claim, the tribunal recorded that the claimant sought payment for 93.25 hours at £8 per hour. It also noted that Employment Judge Lewis had previously directed the first respondent to answer whether the claimant had worked 110 hours and been paid only for 17 hours, but no response was provided. In those circumstances, the tribunal found the claim for unauthorised deduction of wages well founded and awarded £746 gross, being 93.25 hours multiplied by £8.

On holiday pay, the claimant said he had worked for 3.5 weeks and the tribunal accepted his evidence that the first respondent had calculated his holiday entitlement at 13.5 hours. The tribunal found that the third respondent had failed to pay that entitlement and awarded £108 gross, being 13.5 hours multiplied by £8. The judgment does not record any separate award of interest or other sums.
