Tribunal's reasoningThe tribunal found that Mr Cosimo D’Amato had suffered unlawful deductions from wages between 1 September 2020 and 4 January 2021. It accepted that he had been receiving furlough pay up to and including 31 August 2020, that no payment was made from 1 September 2020 onwards, and that he had asked what was happening without receiving a reply. In the absence of any contrary evidence, the tribunal treated 4 January 2021 as the effective date of termination.
On that basis, the tribunal found an 18-week loss of earnings at the claimant’s weekly net wage of £244.03, giving £4,392.54 for unlawful deductions from wages. It also found that the claimant had not been provided with written terms and conditions of employment and awarded two weeks’ pay at the gross weekly rate of £269.88, totalling £539.76, for that failure.
The total award was £4,932.30. The written reasons are a short remedy judgment and do not record any separate findings on working time beyond the award for unpaid wages and the award for failure to provide written particulars.
