Tribunal's reasoningMr Stephen Bone had presented a claim against Ms Deborah Defoy, but the tribunal recorded that he had died after bringing the case. On 13 June 2022 the tribunal ordered his widow to confirm whether she had been appointed as the claimant's personal representative and whether she wished to continue the claim on behalf of his estate.
No response was received to that order. By a letter dated 22 September 2022, the tribunal gave the widow another opportunity to request a hearing or to explain in writing why the claim should not be struck out because it had not been actively pursued. She did not respond. The tribunal said it appeared that she did not wish to continue the claim on behalf of her late husband and therefore struck the claim out under rule 37. No monetary award was made.
