Tribunal's reasoningThe respondent's response was rejected as out of time and a default judgment had been issued. At the remedy hearing the claimant gave evidence that he had been employed from 1 June 2014 until his dismissal in August 2021 and that he had bowel cancer, which the tribunal found was a disability within s.6 Equality Act 2010.
The tribunal found the claimant was unfairly dismissed. It accepted that there had been no warning of dismissal, no discussion about his return to work, and no medical advice sought before dismissal. The tribunal also found discrimination arising from disability because the respondent believed the claimant was not fit to work because of his disability and dismissed him because of his current disability.
For remedy, the tribunal calculated weekly pay at £140. It awarded a basic award of £1,470, future loss of 26 weeks at £140 per week, injury to feelings of £5,000 for a one-off event, and £500 for loss of statutory rights, making a total of £10,610. Recoupment did not apply.
