Tribunal's reasoningOn 6 September 2023 the Tribunal wrote directly to the claimant giving him until 20 September 2023 to make representations or request a hearing on why the claim should not be struck out. That letter followed an earlier strike-out warning dated 18 July 2023, which had required a response by 1 August 2023 and said strike out was proposed because the claimant had not complied with the Tribunal’s orders of 5 August 2022 and 12 March 2023 and because the claim had not been actively pursued.
By 1 November 2023 the claimant and his representative had still not made written representations and had not asked for a hearing. The Tribunal therefore struck out the claim. The reasons also record that the hearing listed for 15 to 22 April 2024 would not take place.
The judgment does not determine the merits of any underlying complaint. It is a procedural strike-out decision under rule 37, made because the claimant had not responded to the Tribunal’s warning and had not complied with the earlier case management orders.
