The tribunal found that both parties had been sent notice of the revised telephone hearing and had been required to provide contact telephone details by 10am two working days before the hearing. Neither party did so, and neither had contacted the tribunal since 25 January 2020. The claimant had not provided a telephone number in the ET1, and tribunal staff found no recent email communications from either party.
Employment Judge Hyams applied rule 47 and concluded that it was right to dismiss the claimant's claims in the circumstances. The judgment noted that the claimant could apply for reconsideration under rule 71 within 14 days if she had good reason for not attending and wished to press the claim.
