The Tribunal heard the matter at a private preliminary hearing by video link in Reading on 17 March 2021, with Employment Judge Vowles sitting alone. After reading the parties' documents and hearing submissions, it granted the Claimant's application to reconsider the rejection of the claims against the 1st and 3rd Respondents. The Tribunal held that the ACAS Early Conciliation Certificate issued on 17 September 2019 naming Active Assistance (UK) Group was sufficient to cover all three Respondents, that the earlier rejection was wrong under Rule 13(1)(a), and that the error in the Respondents' names meant it would not be in the interests of justice to reject the claims under Rule 12(2A).

The Tribunal therefore held that the claims against all three Respondents were valid and that the date of presentation for all three was 17 October 2019. The Respondents' application to strike out the claims as outside jurisdiction on time-limit grounds, based on the earlier rejection and later rectification on 20 June 2020, was refused. The separate claim no. 3325869/2019 was dismissed upon withdrawal by the Claimant. The judgment records that reasons were given orally and that written reasons would not be provided unless requested within 14 days.
