The judgment of 28 June 2019 dealt only with the claimant's application for reconsideration of the judgment sent to the parties on 11 June 2019. Employment Judge Spencer refused the application.

The judge held that there was no reasonable prospect of the original decision being varied or revoked. The reasons given were that the claimant largely repeated submissions already made at the original hearing, or sought to raise points that could and should have been made when she had the opportunity to do so at that hearing.

The tribunal said it was not necessary in the interests of justice to allow further submissions after a decision had been reached, because doing so would undermine the finality of litigation. No substantive merits decision or remedy was made in this reconsideration judgment.
