Tribunal's reasoningThe Claimant brought a claim for outstanding holiday pay after an assignment through the Respondent from 4 June 2018 to 27 July 2018. The Respondent filed a response saying that the Claimant had never worked for it, but did not attend the hearing and was not represented.
The Tribunal accepted the Claimant's evidence, including a payslip issued by the Respondent showing holiday pay and year-to-date earnings from the Respondent. It found that the Claimant was a worker under a contract to personally provide services and that the Respondent was responsible for paying his wages.
The Tribunal found that the Claimant had accrued 4.307 days' statutory holiday, had been paid for 3.125 days, and was owed 1.182 days, equivalent to 9.456 hours at £8.01 per hour. It awarded £75.74 for the unlawful deduction from wages and also ordered the Respondent to pay £13.70 for the Claimant's travel expenses to attend the Tribunal as a witness.
