The case was heard at Bury St Edmunds on 1 October 2018 before Employment Judge Laidler. The respondents did not attend. The tribunal recorded that Ankhor Ltd had written on 24 September 2018 saying it was prepared to pay £667.79, but no settlement had been reached and the hearing proceeded.

The tribunal entered judgment for the admitted sum of £667.79. It also awarded £365.41 in respect of a further deduction from the claimant’s final pay. On that issue, the tribunal accepted the claimant’s evidence that he had not seen the letter relied on by the respondent, and it found no evidence of proper notification to him or that his consent had been obtained.

The tribunal was not satisfied that a claim for failure to inform and consult under regulation 15 of TUPE 2006 was actually before it. It therefore made a case management order for the claimant to consider whether he wished to pursue that issue by application to amend. It also clarified that the claimant’s request to recover £680 for attendance time and £46.44 mileage was not a costs award as sought, and that any further application would have to be for preparation time costs under the tribunal rules.
