Mr G Elliott v Portman Motors Ltd — 2017

This was a Rule 21 judgment issued because no response had been presented to the claim. On the material available, Employment Judge Frances Eccles determined the claims without an answered defence and cancelled the hearing listed for 21 June 2017.

The tribunal held that the respondent had made an unauthorised deduction from the claimant's wages and ordered payment of £328. It also found that the claimant had been dismissed in breach of contract in respect of notice and awarded damages of £3,840, calculated as 12 weeks at £320 per week.

The tribunal further found that the claimant had been dismissed by reason of redundancy and was entitled to a redundancy payment of £9,120, calculated as 28.5 weeks at £320 per week. It also held that the respondent had failed to pay the claimant's holiday entitlement and ordered payment of £405.

In addition, the respondent was ordered to reimburse the claimant's tribunal fee of £160. The amounts ordered in the judgment therefore total £13,853, including the fee reimbursement.
