Key findings
Tribunal's reasoningThe hearing was held in Edinburgh by CVP on 25 January 2022 before Employment Judge Murphy. The claimant, Mr N Meron, did not attend and was not represented. The respondent, Mr P Tomaszek, was present in person. The tribunal recorded that notice of hearing had been sent by email on 13 December 2021, and that the Tribunal Clerk also sent emails on 13, 18 and 24 January 2022 about the hearing arrangements and a CVP test.
The tribunal further recorded that the Clerk checked the email address used for the Notice of Hearing against the address on the ET1, and also tried to telephone the claimant on 19 and 24 January 2022 using the phone number in the claim form. No communication had been received from the claimant after the Notice of Hearing was issued. The tribunal waited until 10.10 am after asking the Clerk to try again by phone when the claimant had not appeared at 10.00 am.
In those circumstances, and having considered the information available about notice and the absence of any communication from the claimant about non-attendance, the tribunal dismissed the claim pursuant to Rule 47 of the Employment Tribunals Rules of Procedure 2013. The judgment does not record any merits findings on the pleaded claims.

How we got this data
Case essentials (reference, date, judge, venue, country, claim categories) are extracted from the structured metadata gov.uk publishes alongside each decision. Parties and monetary figures are extracted from the judgment PDF text. Key findings and per-claim outcomes require a second extraction pass that is not yet complete for this case — until then, the primary source linked above is the authoritative record.
