Tribunal's reasoningThe claimant started work on 5 September 2017 at Roasters Deli. The tribunal found that she was employed by Get Roasted Ltd, which was owned by Mr Jamie Crawford. It accepted that Mr Declan Doran and Mr Kieran Cannon managed the business during the period when Mr Crawford had stepped aside, and it noted that the claimant had not been provided with a contract of employment or wage slips.
The tribunal accepted the claimant's evidence that she was paid £650 on 4 October 2017 for the period 5 to 22 September, and £993.60 on 31 October 2017 for the period 23 September to 22 October. It found that she was not paid wages for 23 October to 31 October, amounting to £259.20, and that she was also not paid £205 holiday pay.
Because no response had been entered, the tribunal determined both the correct identity of the employer and the merits of the claim. It held that the claimant was entitled to payment of the unpaid wages and holiday pay from Get Roasted Ltd and ordered those sums accordingly. The claim against Jamie Crawford in S/41 00230/2018, and the claims against the second, third, fourth and fifth respondents, were dismissed.
