Mr A Bitta v AA Logistics Solutions Limited — 2023

Mr A Bitta brought a claim complaining that AA Logistics Solutions Limited had failed to pay his outstanding wages and other contractual payments on termination. The respondent did not present a response and did not attend the remote hearing. The tribunal relied on the claimant's contract, messages and P45, and was satisfied it could make findings despite technical issues during the hearing.

The tribunal found that the claimant had been employed as a multidrop driver from 21 November 2022 until 6 December 2022 on a salary of £1,800 per month. It accepted that he had received no payment of wages or expenses on termination. On that basis, it calculated the wages due at termination as £946.85 gross and held that the respondent's failure to pay that sum amounted to an unlawful deduction from wages under section 23 of the Employment Rights Act 1996.

The tribunal also found that the claimant had paid £25 for a basic disclosure from Disclosure Scotland, which the respondent had confirmed would be reimbursed in his first wage. As that expense had not been repaid and remained outstanding on termination, the tribunal held that there was a breach of contract and ordered payment of £25. The total sum awarded was £971.85.
