Tribunal's reasoningThe claimant attended a case management preliminary hearing on 23 June 2023. Following that hearing, the tribunal issued orders on 29 June 2023 in relation to his complaints of unfair dismissal, age discrimination, notice pay and holiday pay.
The tribunal found that the claimant did not comply with those orders and did not contact the tribunal after they were issued. On 13 July 2023 he was reminded to comply. On 4 August 2023 the tribunal issued a strike out warning and gave him an opportunity to provide written reasons or request a hearing on why the claim should not be struck out.
No reply was received. The tribunal therefore struck out the claim under rule 37 of the Employment Tribunals Rules of Procedure 2013 on the grounds of noncompliance with tribunal orders under rule 37(1)(c) and that the claim had not been actively pursued under rule 37(1)(d).
