Tribunal's reasoningOn 26 June 2023 the tribunal told the claimant that, because the respondent company was in liquidation, she needed court consent for the claims to proceed. The reasons record a series of letters and directions between June 2023 and July 2024 asking the claimant to pursue the relevant consent, first by seeking the liquidator's permission and then by seeking the consent of the court dealing with the insolvency.
The claimant sent updates until February 2024, but after the tribunal's letters of 23 February, 10 April, 7 June and 9 July 2024 she did not reply by the dates given or request a hearing. The tribunal noted that the strike-out warning letter on 19 June referred only to one live claim, while the 9 July letter referred to both claims and gave the claimant an opportunity to provide written reasons or ask for a hearing.
The tribunal therefore struck out the claims under rule 37(1)(d) on the basis that they were not being actively pursued. It recorded that the claimant had failed to give an acceptable reason why that judgment should not be made or to request a hearing.
