The tribunal then gave repeated opportunities for the claimants to confirm their position, but no response was received by the deadlines of 9 December 2022, 19 December 2022, and 23 December 2022, and a further letter was sent on 11 January 2023.
When no response was still received, the tribunal issued a strike-out warning on 8 February 2023 requiring a response by 22 February 2023. There was again no response. The tribunal held that the claims had not been actively pursued and struck them out under rule 37(1)(d) of the Employment Tribunals (Constitution and Rules of Procedure) Regulations 2013. No remedy was awarded.
