Tribunal's reasoningOn 25 November 2023, Mrs M Shields told the tribunal that she had reached settlement with BW (Gardening) Limited (In Liquidation). On 28 November 2023, the tribunal asked her to confirm whether she intended to withdraw the claim, explaining that it would then be dismissed. No response was received.
The tribunal wrote again on 8 December 2023 asking for a response by 15 December 2023, but no reply was received. On 8 January 2024, the tribunal gave the claimant a further opportunity to provide written reasons by 22 January 2024 or to request a hearing to address why the claim should not be struck out.
The claimant did not provide an acceptable reason and did not request a hearing. The tribunal therefore struck out the claim under rule 37 of the Employment Tribunals (Constitution and Rules of Procedure) Regulations 2013 on the basis that it had not been actively pursued under rule 37(1)(d). No monetary remedy was awarded.
