Tribunal's reasoningThe claim was undefended. No response was received from either respondent, and neither attended the hearing on 28 June 2019. The claimant appeared in person and provided brief evidence together with a small bundle of documents.
On the evidence provided, the tribunal found that the claimant had not been paid for nine working days between 1 and 13 March 2019, after being paid in full up to the end of February 2019. It calculated that sum at £1,730.77 by dividing the claimant's annual salary of £50,000 by 260 working days and multiplying by nine.
The tribunal also accepted that the claimant was owed £192.31 for one day's accrued but untaken annual leave at termination, and £927.22 in respect of a tax rebate that had been remitted to the respondents but not paid to him. That figure was derived from the difference between PAYE deductions shown on the payslips, totalling £6,767.06, and the tax total recorded on the P45, namely £5,839.84.
The tribunal therefore ordered the respondents to pay £2,850.30 in total by way of unlawful deductions from wages.
