R Gall Miss J Watson v Respondent — 2018

The hearing was listed for 11 January 2018 in Glasgow before Employment Judge Robert Gall. The claimant did not attend and was not represented. The tribunal noted that the claimant had not given a telephone contact number on the claim form, so the clerk sent an e-mail soon after 10am asking her to contact the tribunal by telephone. By 10.30am there had been no response. The respondent appeared through Mr Stewart, who said that any sums the respondent regarded as payable had been paid.

The tribunal considered the claim form and response and noted that the response appeared to accept that an element of wages was due, while there was a dispute about holiday pay and any payment in respect of notice. No evidence was tested because the claimant was absent and had given no explanation for not attending. Applying Rule 47 of the Employment Tribunals (Constitution and Rules of Procedure) Regulations 2013, the tribunal dismissed the claim.
