The claimant brought claims for unauthorised deductions from wages under section 13 of the Employment Rights Act 1996 and for failure to give notice of dismissal under section 86 of the same Act. The case was dealt with by written submissions. The respondents did not file any substantive response, and Mr Dobson’s ET3 did not defend the claim, although it accepted that the claimant was entitled to certain payments.

The tribunal accepted the claimant’s account as uncontested. It found that he was employed from 23 May 2016 until 9 February 2018, when his contract was terminated without notice. It also found that his net weekly wage was £498.20 and that at termination he was owed two weeks’ wages for 27 January 2018 to 9 February 2018.

On that basis, the tribunal held that the claim for unlawful deductions succeeded and the notice claim also succeeded. It ordered the respondents to pay the claimant £1,494.60 in total, made up of £996.40 for the two weeks’ unpaid wages and £498.20 for one week’s notice pay.
