Claimant v Onsite PM Ltd — 2023

Ms N Finn brought a claim saying she had not been paid for a period of notice and for holidays. The respondent did not enter a response and did not appear at the hearing on 6 January 2023, so the tribunal heard evidence from the claimant only.

The tribunal found that the claimant had been employed from 27 March 2022 to 11 August 2022, that she earned £1,666 gross per month and £1,433 net per month, and that she had worked one week at the start of her employment without payment on the understanding it would be paid at the end. It also found that she gave two weeks' notice, worked one week of that notice, and did not receive payment for the second week.

The tribunal accepted that she had not been paid for the lying week and that she had four days of accrued but unpaid holiday at termination. It recorded the claimant's own calculation of £392.15 for the notice week, £392.15 for the lying time, and £313.72 for holiday pay, and found the claims were well founded.

The tribunal ordered the respondent to pay £1,098.02 gross, described as payment for one week of notice, one week of wages, and four days of holiday. The judgment did not apportion the total award between the individual heads of claim.
