The tribunal found that the claimant had been employed by Hrafn Shetland Ltd as a Shop Assistant from 8 April 2019 until she was summarily dismissed on 13 August 2022, following dismissal on 12 August 2022 as described in the reasons.
On the wages claim, the tribunal was satisfied that £598.50 was due, consisting of 57 hours worked at £10.50 per hour. It held that the claim under s.23 of the Employment Rights Act 1996 was well-founded and ordered payment of that sum as unlawful deductions from wages.
The tribunal also accepted that the claimant should have been given 3 weeks' notice of termination. Using her average net weekly pay, it assessed the notice entitlement at £598.50 and awarded that amount as damages for breach of contract. In addition, it found that, on the basis of 3 years' complete service, the claimant was entitled to a redundancy payment of £897.75.
The tribunal noted the claimant's concern that she had not received a P60 or P45, but said it had no authority to order the respondent to issue those documents.
