Tribunal's reasoningThe tribunal held a preliminary hearing before Employment Judge Young, at which the respondent was represented by Mr A Maxwell and the claimant did not appear. In the preliminary hearing note, the claimant was ordered to explain why they had not attended and to say whether they intended to pursue the claim, on notice that the claim might be struck out if no response was provided.
The claimant did not provide a response within the 21 days allowed. On 1 June 2021, the tribunal gave the claimant a further opportunity to provide written reasons by 27 May 2021 or to request a hearing on why the claim should not be struck out. The claimant still did not give an acceptable reason or request a hearing.
The tribunal therefore struck out the claim under rule 37 of the Employment Tribunals Rules of Procedure 2013 on the ground that it had not been actively pursued under rule 37(1)(d). No remedy or award was made.
