Tribunal's reasoningThe tribunal did not reach the merits of the claim. It recorded that Mr A Chiovini failed to attend the hearing on 8 November 2019 and gave no explanation or notification of absence.
After that non-attendance, the tribunal wrote to the claimant on 8 November 2019 giving him until 15 November 2019 to provide written reasons or to request a hearing on strike-out. A further letter dated 19 November 2019 required the same information by 26 November 2019.
The claimant did not reply to either letter. The tribunal found that he had not given an acceptable reason why judgment should not be made and had not requested a hearing. It therefore struck out the claim under rule 37 of the Employment Tribunals (Constitution and Rules of Procedure) Regulations 2013, on the ground that the claim had not been actively pursued under rule 37(1)(d).
