Key findings
Tribunal's reasoningMrs Kelly Parkin, Mrs Alison Turriff, Ms Chloe Murray, Mrs Karen Hay and Mrs Kelly Barclay brought undefended claims against Heather Campbell trading as Happy Days Nursery in relation to redundancy pay, pay in lieu of notice and accrued holiday pay after their employment ended on 28 May 2021. The tribunal recorded that the respondent was owned and managed by Mrs Campbell and that the premises were rented from the Local Authority.
The tribunal accepted the claimants' evidence as wholly credible and reliable, and said it accorded with the ET1 claim forms. It found that each claimant had been employed by the nursery until dismissal, that none had received notice or redundancy pay on termination, and that holiday entitlement had accrued up to the termination date.
A certificate of correction dated 18 November 2021 amended some of the figures in the original judgment. On the corrected figures, the tribunal awarded Mrs Parkin redundancy pay of £1,389.96, notice pay of £1,621.62 and holiday pay of £1,389.96; Mrs Hay £4,864.86, £2,779.92 and £1,389.96; Mrs Turriff £6,718.14, £2,779.92 and £1,389.96; Mrs Barclay £3,608.55, £2,779.92 and £1,608.80; and Ms Murray £103.20, £206.40 and £619.20. The total award recorded from the corrected judgment is £33,250.37.
