Tribunal's reasoningMiss L McDougall presented a claim on 22 September 2019 alleging maternity discrimination against G4S Secure Solutions (UK) Limited. At a telephone preliminary hearing on 20 December 2019, she was directed to provide a specification of the unfavourable treatment she said was because of her pregnancy, confirm the dates of the protected period, and submit a draft schedule of loss by 10 January 2020.
The claimant did not comply with those directions. A reminder was sent on 13 January 2020, but no response was received. The respondent then applied for an unless order, and the claimant was asked for comments by 28 January 2020; she did not reply. On 30 January 2020, the Tribunal gave her a further opportunity to provide written reasons by 6 February 2020 or request a hearing to explain why the claim should not be struck out.
The claimant did not provide acceptable reasons, did not request a hearing, and also failed to dial into the telephone preliminary hearing listed for 10 February 2020. The Tribunal therefore struck out the claim under rule 37 on the basis that it had not been actively pursued under rule 37(1)(d). No remedy was awarded.
