On wages, the tribunal accepted that the claimant had worked a total of 169.5 hours in August at an hourly rate of £10.50, and that he had not been paid for those hours. It also accepted that he had not been paid for overtime worked in July. The tribunal found wages of £2,471.87 were due and upheld the unlawful deduction from wages complaint.
On holiday pay, the tribunal accepted the claimant's calculation that holiday accrued but untaken at termination amounted to £997.50 and upheld that complaint. On notice, the tribunal found the claimant was entitled to one week's notice, that the respondent did not give that notice, and awarded £606.38.
The tribunal also accepted the claimant's contract showed a fixed term due to expire on 7 November 2019, and that he was summarily dismissed mid-shift on 19 August 2019. It found the respondent terminated the fixed-term contract early without entitlement to do so and awarded £7,779.45, being the wages the claimant would have received to the end of the term. The total award was £11,855.20.
