Tribunal's reasoningThe tribunal recorded that the claimant did not take part in the telephone case management conference on 24 March 2020. A copy of the preliminary hearing note was sent to the claimant on 30 April 2020 asking her to confirm by 7 May 2020 whether she was proceeding with the claim, but no reply was received.
On 10 June 2020 the tribunal gave the claimant a further opportunity to provide written reasons by 24 June 2020, or to request a hearing to explain why the claim should not be struck out. The claimant did not provide an acceptable reason and did not request a hearing.
The Employment Judge therefore struck out the claim under rule 37 of the Employment Tribunals (Constitution and Rules of Procedure) Regulations 2013 on the basis that it had not been actively pursued, within rule 37(1)(d).
